Geographical Indicative Products (Registration and Protection) Rules, 2015 published

Government on August 3, 2015 published the Geographical Indicative Products (Registration and Protection) Rules, 2015 through a gazette notification. It was published under the Geographical Indicative Products (Registration and Protection) Act, 2013 which was enacted on December 2013.

The rules provide specific procedures, forms and fees for various activities related to registration of Geographical Indicative Products.

Pursuant the rules, the Registrar may, for the purpose of registration, categorize various products. All application for registration should be made in prescribed GI Form 1 or GI Form 2 and must be supported by other documents. After submission, the Registrar will review the application and may return the same if the Registrar finds any problem. The Registrar also has the power to reject the application.

Accepted application will be published in the Journal and any objection shall be made within 2 months from the date of the publication. If no objection is received by the Registrar, then registration may be issued by the Registrar.

The rules also prescribed the provisions related to permitted user, renewal, amendment of the registration.
