Ministry of Industry on September 20, 2015 published Trademark Rules 2015 trough official gazette. It will supplement the Trade Mark Act 2009 and repealed the Trade Marks Rules 1963.
There are 72 rules and 6 schedules in the rules. It also introduce some new forms.
Pursuant to the rules, all forms and related documents should be submitted on ISO A4 Size (and at least) 80 GSM white paper. All documents must be authenticated by the relevant authorities of the respective countries.
All the prescribed forms are in Bangla. The rules also allow submission of documents in both Bangla and English language. Previously only English language was allowed.
The rules classified goods and service pursuant to the NICE Agreement Concerning the International Classification of Goods and Services for the Purposes of the Registration of Marks, 1957. It has also a separate classification for textile marks.
The rules provide detail guideline for registration of collective marks. Any application for registration of collective marks should contain the following information:
- Name and address of the association;
- Purpose of the association;
- Derails of the members of the association;
- Criteria for membership;
- Conditions for the use of the marks;
